Terms of Service

Welcome to Survival at Court! These Terms of Service ("Terms") govern your use of our mobile game "Survival at Court" (the "Game") provided by Bin Xu ("we," "our," or "us"). By downloading, installing, or using the Game, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the Game, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Game.
2. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for personal, non-commercial purposes on devices you own or control, subject to these Terms.
3. Age Requirements
The Game is intended for users aged 12 and above. By using the Game, you represent that you are at least 12 years old. If you are under 18, you must have parental or guardian consent to use the Game.
4. User Conduct
You agree not to:
- Use the Game for any illegal or unauthorized purpose
- Modify, adapt, hack, or reverse engineer the Game
- Create derivative works based on the Game
- Remove, circumvent, or disable any security features or copyright notices
- Use any automated means to access the Game
- Interfere with or disrupt the Game or servers
- Transmit viruses, malware, or other harmful code
- Collect or harvest information about other users
5. Intellectual Property
All content in the Game, including but not limited to text, graphics, logos, images, audio, video, game mechanics, and software, is the property of Bin Xu or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, or distribute any content from the Game without our prior written permission.
6. Virtual Items and Currency
The Game may include virtual currency, items, or other virtual goods ("Virtual Items"). Virtual Items have no real-world value and cannot be exchanged for real money or tangible goods. We reserve the right to modify, manage, control, or eliminate Virtual Items at any time.
7. Advertisements
The Game displays third-party advertisements through Google AdMob. By using the Game, you agree to the display of these advertisements. We are not responsible for the content of third-party advertisements or the products or services they promote.
8. Privacy
Your use of the Game is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Game, you consent to our privacy practices as described in the Privacy Policy.
9. Updates and Modifications
We may update, modify, or discontinue the Game or any part thereof at any time without notice. We may also modify these Terms at any time. Your continued use of the Game after any modifications indicates your acceptance of the updated Terms.
10. Disclaimer of Warranties
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIN XU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE GAME.
12. Indemnification
You agree to indemnify, defend, and hold harmless Bin Xu and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Game or violation of these Terms.
13. Termination
We may terminate or suspend your access to the Game at any time, with or without cause or notice. Upon termination, your license to use the Game will immediately cease. You may terminate these Terms by deleting the Game from your device.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Game shall be resolved in the courts of competent jurisdiction.
15. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Game shall first be attempted to be resolved through good faith negotiations. If negotiations fail, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bin Xu regarding the Game and supersede any prior agreements.

19. Apple-Specific Terms
If you access the Game through an iOS device:
- These Terms are between you and Bin Xu only, not Apple
- Apple has no obligation to provide maintenance or support for the Game
- Apple is not responsible for any product warranties or claims
- Apple is not responsible for addressing any third-party claims
- Apple and its subsidiaries are third-party beneficiaries of these Terms
20. Google Play-Specific Terms
If you access the Game through Google Play, you must also comply with the Google Play Terms of Service.
